Sex charge will be defended

A BATHURST man alleged to have had a homosexual relationship with a 13-year-old boy at St Stanislaus College will strenuously defend charges against him in Bathurst Local Court.

Solicitor Tim Cain said yesterday that Richard John McPhillamy, 48, was pleading not guilty to 11 charges against him, one of having had sex with the teenage boy between October and December 1985.

McPhillamy, of Laws Place, Bathurst, has also been charged by police investigating an alleged paedophile ring at St Stanislaus College, on three counts of sexual assault with an act of indecency 24 years ago.

In addition to the sex charges, McPhillamy is alleged to have had pornographic images in his possession on seven separate occasions last year.

Director of Public Prosecutions lawyer, Beth Walker, has withdrawn six original charges against McPhillamy related to indecent assault and pornography and replaced them with the 11 matters now before the court.

The original charges had been laid after McPhillamy, accompanied by a solicitor, attended Bathurt Court House in December last year when two indecent sex charges had been laid.

Mr Cain said the DPP should serve briefs of evidence for McPhillamy to reply to the allegations against him when the case returns to the court on Wednesday, September 2 at Bathurst Court House.

The solicitor indicated McPhillamy would not agree to have his matters dealt with in Sydney where five former Vincentian brothers and priests have had their cases listed since the former Bathurst Local Court magistrate, Thomas Hodgson disqualified himself from hearing the St Stanislaus matters at the insistence of Ms Walker.

McPhillamy, who appeared yesterday before magistrate Jan Stevenson, is on continuing bail which includes him reporting once per week to the officer-in-charge of Bathurst Police Station.

Bail is conditional that McPhillamy does not associate with persons under the age of 16 years in any activities.

Also that he not approach any of the alleged victims in the case.
